REQUEST FOR PROPOSAL-Telecom Broadband Connectivity Technology: Approval and Expense Reimbursement from FCC Healthcare Connect Fund (HFC)

Description: SUNY Downstate Health Sciences University seeks a vendor to provide telecom broadband connectivity services and to act on its behalf before the FCC Healthcare Connect Fund (HCF) to obtain approval and expense reimbursement. The vendor must ensure SUNY-DHSU’s ongoing participation and compliance with FCC HCF regulations, maintain required rural-to-urban site ratios, and apply for reimbursements for 2026–2030 under a five-year contract. Payment is made only after reimbursements are approved and disbursed, and minimum qualifications include at least five years’ experience working with similar-sized hospitals.

Fund Administrator: The duties of the Administrator shall include the following Scope of Services: 1. Prepare a coverage manual detailing all lines of insurance coverage provided by the Fund to Member municipalities (whether insured, self-insured or reinsured) as required by the Fund’s risk management plan. Upon adoption, copies of the coverage manual will be provided for distribution to Fund Members, their risk management consultant, and to each of the professionals and other service companies retained by the Fund. It is expressly understood and agreed to by the Administrator that the coverage manual is and shall remain the property of the Fund. 2. Prepare renewal underwriting surveys and/or questionnaires for distribution to Member municipalities; secure such surveys from the Member municipalities and compile the information and exposure data in a consolidated report by Member. Prepare a summary of updated exposure data for each member and verify the accuracy of the data with the risk management consultant.

Fund Attorney: a. Provide the necessary counsel and guidance so as to ensure that the Fund is in full compliance with all NJ legal and regulatory requirements. b. Provide the Fund with ongoing reports and advice on legislative and regulatory changes which impact the Fund’s operations and/or finances. c. Review and analyze pertinent case law and provide the Fund with guidance and counsel on same. d. Review contracts and service agreements for the Fund as needed. e. Assist in the evaluation and hiring of claims defense attorneys. Conduct regular meetings with defense firms to ensure compliance with Fund Litigation Guidelines and uniform application of policy positions. f. Conduct periodic reviews of defense firms’ files, with particular attention to briefs submitted on behalf of the Fund. g. Provide the Fund Claims Administrator with legal guidance where necessary, particularly in new and evolving areas of the law. This includes issuing periodic bulletins on emerging legal, regulatory, or case law matters.
